Accident Waiver and Release of Liability Form
I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH RENTAL OF Marietta Retreat (“Property”) from Owner, including by way of example and not limitation, any risks of bodily injury to the person due to use of the: hot tub, fire pit, grill, game room, playset, any other amenities, any other amenities, and any other areas of the premises associated with the Property.
I certify that I and the other guests accompanying me are physically fit and have not been advised to not participate by a medical professional. I certify that there are no health-related reasons or problems which preclude my or my guests’ participation in this rental.
I acknowledge that this Accident Waiver and Release of Liability Form will be used by the holders, and that it will govern my actions and responsibilities at said activity.
I hereby take action for myself, my guests, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity, THE FOLLOWING ENTITIES OR PERSONS: Owner, including their contractors, employees, volunteers, representatives, and agents;
(B) INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity, whether claimed by myself or my guests.
I acknowledge that use of the hot tub, fire pit, grill, game room, playset, and other amenities may involve a test of a person’s physical limit and carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, lack of hydration, and actions of other people including, but not limited to other third parties assisting in the activity. These risks are not only inherent to participants, but are also present for other people.
The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
House Rules
Smoking / vaping / hookah is prohibited inside. If you do smoke outside, please pick up all remnants. There will be a $500 fine for smoking inside the house.
Pets are welcome.
No parties allowed - There will be a $1,000 fee for a party. The maximum amount of people allowed is the amount listed at the time that you book. A maximum of 12 guests are allowed at the time of booking. There will be a $1,000 fee if there are any parties or more than 12 guests at the property without prior approval.
I agree to pay these fees if I am in violation of the house rules.
I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
